In November 2017, Mr Henderson provided lawyers acting for Tatiana in Liechtenstein and Switzerland a number of documents relevant to a strategy deployed by Farkhad to evade enforcement.
In November 2019, Mrs Justice Knowles delivered judgement on a procedural matter (Akhmedov v Akhmedova and ors [2019] EWHC 3140 (Fam)) which gave directions over the admissibility of documents provided to Tatiana’s solicitors in 2017 by the former director of the husband’s family office, Mr Ross Henderson.
Mrs Justice Knowles accepted that documents were confidential but were admissible through the ‘fraud’ exception to privilege. The judgment noted that:
“brief perusal of the Reviewable Documents shows that they form part of the fraudulent scheme to defeat the Wife’s claims, including both by moving assets to jurisdictions in which enforcement would be impossible and by granting charges over those assets to frustrate enforcement”.
Tatiana is now free to use the documents to enforce her right to the judgment debt.
